CONSTITUTION

Current following AGM on 29 June 2008

1. GENERAL

(i) The Association will be called the "Essex Volleyball Association".
(ii) The Association will be responsible to the English Volleyball Association and the Eastern Volleyball Federation.

2. AIMS

To promote, encourage and develop the game of Volleyball.

3. MEMBERSHIP

This will be open to any School, Organisation or Club who are interested in promoting and playing Volleyball in accordance with the Association's Constitution and Rules. Those in affiliation to English Volleyball Association either individually or block will automatically be deemed members of the Association.

4. OFFICERS

The Executive Committee will consist of the following
(i) President
(ii) Vice Presidents - The number of Vice-Presidents elected is at the discretion of the Annual  General Meeting.
(iii) Chairperson - To chair and control meetings within the rules of the constitution.
(iv) Secretary - To deal with the general administration.
(v) Treasurer - To deal with the financial matters.

5. ELECTION OF OFFICERS

The Officers of the Association will be elected at the Annual General Meeting as follows
(i) The Chairperson will be elected every other year. This election will take place in even numbered years.
(ii) The Secretary and Treasurer will be elected every other year. These elections will take place in odd numbered years.
(iii) In the event of a two year post becoming vacant within the first year, the term in office will be reduced to one year at the next AGM.
(iv) In the event of one or more posts being unfilled at an AGM the elected Executive has the authority to appoint Committee members with full voting rights. The appointment must be a unanimous decision by the elected Executive. The appointment will be until the next AGM or SGM.

6. EXECUTIVE COMMITTEE

(i) The positions of President and Vice-President are honorary with no voting rights.
(ii) All other Officers have one vote.
(iii) Every decision will be by a simple majority, but in the event of a tied vote the Chairperson may exercise a second and casting vote.
(iv) The Committee has the authority to co-opt members when necessary. Co-opted members will have no voting rights.
(v) The Committee has the authority to set up Sub-Committees, and delegate specific powers to that Sub-Committee.
(vi) A quorum of two Executive Officers is required to transact any business of the Association. This includes those members appointed. (see 5 iv.)
(vii) a) Any item (from clubs) for consideration by the Committee must be communicated in writing and reach
the Secretary at least three days before the next scheduled Committee meeting.
      b) Two representatives (of any affiliated club) can be present at the meeting where the item the have raised is
      discussed.
(viii) All committee and sub committee members must declare an interest in any dispute or appeal and may not vote on the matter.
(ix) The Committee has the authority to decide on any question or matter arising which is not covered by the
      Constitution.

7. FINANCE

(i) The financial year of the Association will end on March 31st. An audited statement of accounts for the current year will be presented to the AGM.
(ii) Annual subscriptions will be decided at the AGM.
(iii) The funds of the Association must be lodged with an established Bank, Building Society or Post Office.

Cheques and instructions for payment must be signed by two Officers from Treasurer, Chairperson or the Secretary.

8. ANNUAL GENERAL MEETING

(i) Not more than 15 months may elapse between AGMs of the Association.
(ii) Two thirds of the affiliated Clubs of the Association must be present to form a quorum.
(iii) The Annual Reports of the Executive Committee will be presented.
(iv) (a) At least six weeks notice will be given of the Date, Time and place of the AGM.
      (b) A further notice of the AGM together with the Agenda and proposed League Rules will be sent out at
least three weeks prior to the meeting.
(v) Only Persons carrying a voting card will be entitled to vote at the AGM. These cards will be issued to the Club Chairperson and the Team Secretaries of clubs active in competitions organised by the Association. However if a Club sends another representative it must be lodged in writing to the Secretary prior to the start of the meeting.
(vi) Votes cannot be exercised by individuals aged under 16
(vii) No individual may vote in more than one capacity.
(viii) All resolutions will be decided by a simple majority. In the event of a tie the Chairperson will have the casting vote.

9. SPECIAL GENERAL MEETING

(i) A Special General Meeting can be called by the Executive Committee or by a resolution signed by authorised representatives of at least three affiliated Clubs.
(ii) Notice for the meeting shall be a minimum of six weeks.
(iii) Two thirds of the affiliated Clubs of the Association must be present to form a quorum.
(iv) Voting at a Special General Meeting shall be the same as the AGM.

10. AMENDMENTS TO THE CONSTITUTION

(i) These can only be made at an Annual or Special General Meeting.
(ii) Proposed amendments must be received in writing by the Secretary at least four weeks before the Annual or Special General Meeting.

11. COMPETITIONS AND LEAGUES

(i) At the discretion of the Executive Committee, Clubs from outside Essex maybe allowed to enter any of the
competitions.
(ii) Written permission must be obtained from the Executive Committee to set up a local League. A copy of the League Rules must be forwarded to the Secretary for ratification.

12. DISCIPLINE

The Association has the authority to take appropriate disciplinary action against any affiliated Clubs and their representatives.

13. APPEALS

There is the right to appeal against any decision on disciplinary sanctions imposed by, or on the authority of the Executive Committee. The written appeal must reach the Secretary within seven days of the sanction. This should be accompanied by a deposit which will be returned if the appeal is successful.

14. DISSOLUTION

In the event of the Association being wound up or dissolved, it's assets would be held in trust by the English Volleyball Association.
